Any model, performer or other individual appearing in any depiction of explicit sexual acts displayed on the website found at tubeporn.tv was eighteen years old or over at the time of the creation of those depictions.

Exemption: Content Produced by Third Parties

The owners and operators of the website are not the "producers" of any actual or simulated sexually explicit content found on the website. Regarding such, the operators of tubeporn.tv restrict their activities to the transmission, storage, retrieval, hosting and/or formatting of the content, be it depictions of explicit or of simulated sexual activity, that is provided by third-party users of the website. All areas of the website that contain user-furnished content are under the control of those users. The operators are thereby exempt from compliance with Section 2257 records keeping and labeling obligations as per 28 C.F.R. §75.1(c)(4). Any content on the website that, at the operator’s sole discretion, is judged to be illegal, unlawful, obscene, defamatory, or which in any manner goes against the website's terms of use or other policies may be deleted.

The visual depictions displayed on the website are not bound by the provision of 18 U.S.C. §§2257, 2257A and/or 28 C.F.R. §75, because: 1) they do not portray behavior as specifically listed in 18 U.S.C §2256 (2)(A) (i) through (iv); 2) they do not portray behavior as specifically listed in 18 U.S.C. §2257A produced after March 19, 2009; 3) they do not portray behavior listed in 18 U.S.C. §2256(2)(A)(v) produced after March 19, 2009; 4) the visual depictions were created prior to July 3, 1995.
